Subrogation

One of the largest manufacturing plants of its kind in Europe suffered two catastrophic failures of bespoke equipment which caused separate, lengthy outages resulting in significant financial losses. One outage was caused by the failure of one specialist
piece of equipment. The other outage was caused by an
explosion and subsequent fire.

Working closely with materials scientists and other experts, evidence has been found to enable insurers to pursue subrogated recoveries against the supervising engineers.
The target company is a Continental European engineering group. The disputes are the subject of ICC arbitration.
